Terms of Service

1. Who We Are
BulkBrains is operated by Crann Moroney, trading as BulkBrains, based in Ireland.
In these Terms, “BulkBrains”, “we”, “us” and “our” refer to Crann Moroney trading as BulkBrains.
You may contact us at support@bulkbrains.com.
2. Acceptance and Scope of These Terms
2.1 Acceptance
By creating an account, purchasing or subscribing to a Service, installing or using BulkBrains software, or otherwise accessing or using a Service, you agree to these Terms.
If you do not agree to these Terms, you must not use the Services.
2.2 Services Covered
These Terms apply to websites, software, applications, plugins, online tools, APIs and other products or services operated by BulkBrains that link to or incorporate these Terms.
These Services may include, without limitation:
- bulkbrains.com;
- BulkBrains Console;
- BulkBrains Heatmap;
- BulkBrains DataMate;
- BulkBrains Verdict;
- SnipTok;
- Qwiky;
- BulkBrains Essentials and associated developer utilities;
- BulkBrains Chaseless;
- ZAVE;
- RouteCard;
- id.bulkbrains.com;
- BulkBrains plugins and downloadable software;
- private or product-integrated APIs;
- beta, preview and experimental services; and
- future websites, applications, integrations or services operated by BulkBrains that refer to these Terms.
2.3 Additional Terms
Certain Services may also have additional product-specific terms, disclaimers, notices or policies. Where additional terms apply, they form part of your agreement with BulkBrains.
If additional terms conflict with these Terms, the more specific terms will apply to the relevant Service to the extent of the conflict.
3. Eligibility
You must be at least 18 years old to use the Services.
By using a Service, you confirm that you are at least 18 and legally capable of entering into these Terms.
BulkBrains does not knowingly offer its Services to minors.
The Services may generally be accessed worldwide, although particular Services, payment methods, APIs, third-party integrations or features may not be available in every country.
You are responsible for ensuring that your use of the Services is lawful in your country or jurisdiction.
4. Consumers and Business Users
These Terms apply to both consumers and Business Users.
A Consumer is an individual using a Service wholly or mainly for purposes outside that individual's trade, business, craft or profession.
A Business User is a person or organisation using a Service in connection with a trade, business, profession, game studio, development activity or other commercial activity.
Certain provisions of these Terms apply differently to Consumers and Business Users.
Nothing in these Terms is intended to exclude, restrict or reduce any rights that a Consumer is entitled to under applicable mandatory consumer law.
5. Accounts
5.1 Account Requirements
Some Services require a BulkBrains account while others may be available without registration.
BulkBrains accounts may support authentication methods including email and password and Google sign-in.
You must provide accurate information when creating or maintaining an account.
5.2 Account Security
You are responsible for:
- maintaining the confidentiality of your login credentials;
- keeping your authentication methods secure;
- securing API keys, Roblox Open Cloud keys and other credentials connected to your account;
- ensuring persons accessing your account are authorised to do so; and
- activity carried out through your account, except where responsibility cannot lawfully be placed on you.
You must notify BulkBrains promptly if you believe your account or credentials have been compromised.
BulkBrains may reset credentials, invalidate sessions, revoke API keys, restrict access or temporarily suspend an account where reasonably necessary to protect the account, BulkBrains or other users.
5.3 Multiple Accounts
You may hold more than one account unless a particular Service states otherwise.
You must not create additional accounts to evade billing, free-tier limits, restrictions, sanctions or suspensions.
5.4 Account Transfers
Accounts must not be sold, assigned or transferred to another person without prior permission from BulkBrains.
5.5 Account Deletion
You may request deletion of your account by contacting BulkBrains support.
Following termination or deletion, BulkBrains may take up to approximately 30 days to remove account data from active systems and additional time for data to disappear from backup systems.
Certain records may be retained where reasonably necessary for billing, accounting, fraud prevention, security, dispute resolution, compliance with law or enforcement of these Terms.
5.6 Inactive Accounts
BulkBrains may delete accounts that have remained inactive for at least 12 months where continued retention is no longer reasonably necessary.
Where practicable, BulkBrains may provide notice before deleting a completed account for inactivity.
Incomplete registrations, unverified accounts or abandoned account records may be removed sooner.
6. Services
6.1 DataMate
DataMate enables users to view and interact with Roblox DataStores through Roblox Open Cloud API functionality.
Users are responsible for providing and securing appropriate Roblox credentials and ensuring they have authority to access the relevant experience and data.
6.2 BulkBrains Heatmap
BulkBrains Heatmap provides analytics relating to Roblox experiences.
The Service may process information including:
- Roblox universe identifiers; and
- player-coordinate information.
Player-location information may be converted into aggregated map blocks or similar analytical values rather than being stored as an ongoing record of an identifiable player's movement.
Developers are responsible for ensuring their use of Heatmap complies with Roblox requirements and applicable privacy and data-protection law.
6.3 BulkBrains Verdict
BulkBrains Verdict allows users to compare submissions, including documents or PDFs, against specified requirements and receive information relating to compliance with those requirements.
Verdict may use artificial intelligence. Outputs are informational and should be independently reviewed before being relied upon for legal, regulatory, contractual, safety-critical or other important decisions.
6.4 SnipTok
SnipTok provides tools relating to automated or assisted video generation and may use artificial intelligence or third-party AI providers.
6.5 Qwiky
Qwiky, including the service available through qwiky.xyz, provides URL-shortening functionality.
Certain paid functionality may include:
- enhanced analytics;
- information concerning the country associated with requests;
- device information; and
- customised shortened URLs.
Users must not use Qwiky for phishing, malware distribution, fraud, spam, unlawful tracking, deceptive redirects or other prohibited activities.
6.6 Chaseless
Chaseless provides automated document-chasing and reminder functionality.
BulkBrains does not generally receive the underlying documents merely because Chaseless is used to request or remind third parties about them.
Users are responsible for ensuring that they are permitted to contact recipients and that reminders they configure comply with applicable law.
6.7 ZAVE
ZAVE is an Irish price-comparison service.
ZAVE may display products, prices and retailer information sourced through third-party affiliate networks or retailers.
BulkBrains does not generally sell those products directly. When a user follows a retailer or affiliate link, any resulting purchase is between the user and the relevant third-party retailer and is subject to that retailer's terms.
Prices, availability and product information may change and should be verified with the retailer before purchase.
6.8 RouteCard
RouteCard is a route-planning and navigation aid.
Use of RouteCard is also subject to the separate RouteCard Safety Disclaimer and Limitation of Liability.
RouteCard must not be used as the sole means of navigation or as an emergency or life-safety system.
6.9 Essentials
BulkBrains Essentials includes a range of smaller utilities and tools, some of which may be available without an account.
Individual Essentials tools may have different functionality, limits and availability.
7. Changes to the Services
BulkBrains may:
- add, remove or modify features;
- change technical requirements;
- change supported integrations;
- impose or modify usage limits;
- replace third-party providers;
- change interfaces;
- update software;
- withdraw older versions;
- discontinue beta features; or
- discontinue a Service.
We do not guarantee that any particular feature will remain available indefinitely.
Where discontinuation affects a paid Service, BulkBrains will deal with unused prepaid service or remaining paid periods fairly and in accordance with applicable law.
8. Free Services, Trials and Preview Features
Some Services may be offered:
- free of charge;
- with free usage limits;
- as a free plan;
- through a free trial;
- in preview;
- in beta; or
- experimentally.
The existence of a free Service does not guarantee that it will remain free.
Where a free trial automatically becomes a paid subscription, this will be disclosed as part of the purchasing or signup process.
Beta, Preview, Early Access and Experimental Services may contain errors, change significantly, be withdrawn, have reduced reliability, lose or alter data or be unavailable without notice.
You should not rely on an experimental Service for critical operations unless BulkBrains has expressly agreed otherwise.
9. Pricing and Payments
9.1 Pricing
Pricing for paid Services will normally be displayed through the relevant Service or purchasing interface.
Prices are generally stated in euro unless indicated otherwise.
Where required, consumer-facing prices will include applicable taxes.
BulkBrains may use charging models including:
- subscriptions;
- usage-based billing;
- free allowances followed by paid usage;
- custom pricing;
- paid features; and
- enterprise arrangements.
9.2 Usage-Based Billing
Some Services may calculate charges based on actual usage.
For example, Heatmap may calculate usage based on events including map-block updates and data transmissions from Roblox game servers.
Where a usage calculator or pricing estimator is provided, it is intended to help users understand likely charges. Unless expressly guaranteed, an estimate is not a fixed-price quotation.
9.3 Payment Processing
Payments may be processed through Stripe or other third-party payment providers.
BulkBrains does not ordinarily receive or store complete payment-card details.
Payment providers may have their own terms, privacy notices, verification procedures and geographic restrictions.
10. Subscriptions
Subscriptions may renew automatically where this is disclosed during purchase.
You may cancel a subscription through the applicable billing-management interface, including the Stripe customer billing interface where provided.
Unless otherwise stated, cancellation takes effect at the end of the current paid billing period.
BulkBrains may change subscription pricing. Unless expressly agreed otherwise, a pricing change will normally apply from a future billing period and will not retrospectively alter fees already incurred.
11. Failed Payments
If payment for a subscription or usage-based Service fails or remains unpaid, BulkBrains may restrict access, pause the affected Service, suspend billable functionality or terminate access after a reasonable period.
BulkBrains does not intentionally allow unpaid usage to accumulate indefinitely into a negative account balance.
You remain responsible for amounts validly incurred before suspension or termination.
12. Refunds
Nothing in this section affects mandatory statutory rights.
BulkBrains may provide refunds, credits or billing adjustments where appropriate, including where:
- a paid Service materially fails to perform as described;
- a Service was barely or not meaningfully used;
- a significant outage substantially prevented use of a paid Service;
- a billing error occurred; or
- BulkBrains permanently discontinues a paid Service for which a user has remaining prepaid entitlement.
Usage that has already been consumed is not normally refundable merely because the user later decides not to continue using the Service.
Refund requests will be considered based on the circumstances.
Where a Consumer has a statutory right to repair, replacement, price reduction, cancellation, refund or another remedy, those statutory rights apply regardless of this section.
13. Consumer Cancellation Rights
Consumers may have statutory cancellation or withdrawal rights for certain distance contracts and digital services.
Those rights depend on factors including the type of Service, when performance begins, whether the Service has been fully supplied and any consents or acknowledgements given during purchase.
Nothing in these Terms removes any cancellation right available under mandatory law.
Where BulkBrains is legally permitted to begin supplying a digital Service during a statutory cancellation period, the purchasing process may request the Consumer's express consent to begin supply immediately and any acknowledgement required by law.
14. User Content and Data
“User Content” means information, files, documents, database information, prompts, routes, text, configuration, analytics information or other material supplied to BulkBrains through a Service.
You retain ownership of your User Content.
Using BulkBrains does not transfer ownership of your Roblox game, database, documents, routes, projects, content or other property to BulkBrains.
You grant BulkBrains a non-exclusive licence to host, store, copy, transmit, process, display, analyse, transform and otherwise use User Content as reasonably necessary to:
- provide the Services;
- operate integrations;
- maintain and secure the Services;
- diagnose faults;
- improve Services;
- perform analytics;
- develop features;
- create benchmarks; and
- fulfil your instructions.
You confirm that you have the rights and permissions necessary to provide User Content to BulkBrains.
15. Promotional and Product Use of User Content
To the extent permitted by applicable law, BulkBrains may use projects, creations, outputs or examples associated with use of the Services for:
- demonstrations;
- product showcases;
- marketing;
- advertising;
- case studies;
- service examples;
- benchmarking; and
- product improvement.
Where BulkBrains publicly showcases an identifiable creator, project, business or company, we will generally seek to provide appropriate attribution or credit.
This provision does not give BulkBrains ownership of the underlying User Content.
Where mandatory law restricts BulkBrains' ability to use particular Consumer-created content for its own purposes, those restrictions apply.
BulkBrains may also use aggregated, statistical or anonymised information that does not identify an individual user or confidential customer content for analytics, benchmarking and service improvement.
16. Artificial Intelligence
Certain Services use artificial intelligence, including services provided by third parties such as OpenAI and Google Gemini.
User inputs or information may be transmitted to such providers where necessary to perform the requested AI functionality.
AI-generated results may:
- be inaccurate;
- omit relevant information;
- contain errors;
- be incomplete;
- resemble outputs provided to other users; or
- contain unsuitable or unexpected content.
AI output should be independently reviewed where accuracy matters.
BulkBrains does not guarantee that AI output is accurate, unique, complete, suitable for a particular purpose or free from third-party rights.
Subject to applicable law and third-party provider terms, BulkBrains does not claim ownership of AI outputs generated specifically for you merely because the output was created through a BulkBrains Service.
BulkBrains does not currently train its own AI models on customer content.
17. APIs and Automated Access
BulkBrains may provide private, integrated or limited API functionality even where no general public API is offered.
API credentials are your responsibility.
BulkBrains may impose rate limits, fair-use restrictions, revoke credentials, restrict automated activity or suspend API access.
API access may be restricted because of abuse, suspected compromise, excessive resource usage, non-payment, security risk, circumvention of limits or breach of these Terms.
You must not resell standalone access to a BulkBrains API without permission.
BulkBrains does not guarantee any particular API uptime or response time unless stated in a separate agreement.
18. Third-Party Services
BulkBrains relies on or integrates with third-party services which may include Roblox, Stripe, affiliate networks, mapping providers, weather providers, AI providers, Google, OAuth providers, hosting providers, databases, email services and external APIs.
Third-party services are not controlled by BulkBrains.
They may become unavailable, change APIs, change pricing, impose limits, block access, discontinue functionality, provide inaccurate information or change their own terms.
BulkBrains is not responsible for the acts or omissions of third parties except where applicable law provides otherwise.
19. Roblox
Certain BulkBrains Services integrate with Roblox.
BulkBrains is an independent service and is not affiliated with, endorsed by, sponsored by or operated by Roblox Corporation.
Roblox and related names and marks belong to their respective owners.
You are responsible for ensuring that your use of BulkBrains in connection with Roblox complies with Roblox's applicable rules, policies, API terms and platform requirements.
20. Open-Source Software
Some BulkBrains software or components may be made available under open-source licences, including the MIT Licence.
Where software is supplied under an open-source licence, that licence governs your rights to copy, modify, distribute or otherwise use that particular component.
These Terms do not remove rights granted to you by an applicable open-source licence.
21. Intellectual Property
Unless otherwise stated, BulkBrains and Crann Moroney own or licence the rights in BulkBrains software, websites, interfaces, branding, logos, graphics, documentation, proprietary APIs, service architecture, databases compiled by BulkBrains and other original BulkBrains materials.
You may not copy, reproduce, sell, exploit or distribute proprietary BulkBrains materials except as permitted by these Terms or applicable law.
You may truthfully state that your project integrates with or uses a BulkBrains Service, but you must not falsely imply sponsorship, endorsement or partnership.
22. Feedback
If you provide feedback, ideas, suggestions or feature requests to BulkBrains, you permit BulkBrains to use, develop and incorporate them without restriction or an obligation to compensate you.
23. Acceptable Use
You must not use the Services to:
- break applicable law;
- commit fraud;
- distribute malware;
- conduct phishing;
- obtain unauthorised access to systems or accounts;
- interfere with or overload BulkBrains infrastructure;
- conduct denial-of-service attacks;
- deliberately circumvent technical limits;
- circumvent billing or payment requirements;
- create accounts to evade usage restrictions;
- send unlawful spam;
- upload or distribute unlawful or infringing material;
- use stolen, unlawfully obtained or unauthorised data;
- distribute malicious files or code;
- harass or abuse others;
- distribute child sexual abuse material;
- distribute unlawful extremist or terrorist material;
- facilitate unlawful gambling;
- facilitate unlawful sales of controlled drugs, weapons or other prohibited goods;
- use BulkBrains to violate Roblox's rules;
- resell access to a Service where resale is prohibited;
- scrape, probe or automate BulkBrains in a manner that materially interferes with the Service;
- bypass rate limits or security mechanisms; or
- otherwise use a Service in a manner likely to harm BulkBrains, its infrastructure, other users or third parties.
Sharing access to a paid account is not automatically prohibited, provided the account holder is authorised to do so and remains responsible for use of the account.
24. Security Testing
You must not probe, scan, penetration-test, exploit, attempt to circumvent security controls or otherwise test BulkBrains systems for vulnerabilities without prior written permission.
Security vulnerabilities should be reported privately to support@bulkbrains.com.
BulkBrains does not currently operate a public bug-bounty programme.
25. Suspension and Termination
25.1 Suspension
BulkBrains may temporarily suspend, restrict or disable access where reasonably necessary because of suspected security compromise, non-payment, fraud, abuse, excessive infrastructure usage, legal requirements, suspected unlawful activity, serious breach of these Terms or threats to other users or systems.
Where reasonable, BulkBrains may provide an opportunity to correct a minor breach before terminating access.
Serious, repeated, fraudulent, malicious or security-related violations may result in immediate suspension or termination.
25.2 Termination by You
You may stop using the Services at any time.
You may request account deletion through BulkBrains support.
Cancelling an account does not automatically eliminate valid amounts already incurred before cancellation.
25.3 Termination by BulkBrains
BulkBrains may terminate an account or Service relationship where reasonably justified, including for material breach, continued non-payment, fraud, unlawful conduct, serious misuse, security risk, repeated infringement, harmful automated activity, misuse of third-party credentials or discontinuation of a Service.
26. Effect of Termination
Following termination:
- access to the relevant Service may stop immediately;
- User Content may be scheduled for deletion;
- credentials and API keys may be revoked;
- unpaid charges already incurred remain payable; and
- provisions concerning intellectual property, liability, disputes and unpaid amounts will continue to apply where appropriate.
BulkBrains is not required to maintain indefinite export access following termination.
Users should maintain their own copies of important information.
27. Data Retention
Unless a Service states otherwise, data that is no longer required may be deleted from active systems within approximately 30 days and may remain temporarily in backups for a further period.
Some records may be retained longer where necessary for legal, accounting, security, fraud-prevention or dispute purposes.
Details of personal-data processing are addressed in the BulkBrains Privacy Policy.
28. Copyright Complaints
If you believe content available through a BulkBrains Service infringes your copyright or other intellectual-property rights, contact support@bulkbrains.com.
Please provide sufficient information for us to understand:
- the work claimed to have been infringed;
- the allegedly infringing material;
- where it appears;
- your relationship to the relevant rights; and
- how we may contact you.
BulkBrains may remove or restrict access to material where reasonably appropriate.
Repeated infringement may result in account termination.
29. Service Availability
BulkBrains aims to keep its Services reliable and available but does not guarantee uninterrupted operation.
Services may be unavailable because of:
- maintenance;
- software errors;
- infrastructure failure;
- third-party outages;
- cyber incidents;
- upstream API changes;
- capacity constraints;
- network problems; or
- events outside BulkBrains' reasonable control.
Unless a separate written agreement expressly provides an SLA, no Service Level Agreement applies.
30. Maintenance
BulkBrains may perform planned or emergency maintenance without advance notice.
Where practical, we may provide notice of significant planned maintenance, but we do not guarantee advance notification.
31. Backups and Data Loss
You are responsible for maintaining appropriate independent copies of information that is important to you.
BulkBrains uses reasonable operational measures but does not guarantee that every piece of data can always be recovered.
You should not treat BulkBrains as your sole backup system unless a specific written agreement expressly states otherwise.
32. Accuracy and Reliance
BulkBrains Services may process or display information supplied by users, third-party APIs, Roblox, affiliate networks, AI providers, mapping providers, weather providers, retailers or other external systems.
Such information may be incomplete, delayed, inaccurate or unavailable.
You are responsible for deciding whether information provided through a Service is appropriate to rely upon.
This is particularly important for:
- legal or compliance decisions;
- financial decisions;
- safety-critical decisions;
- navigation;
- outdoor activities;
- production systems;
- AI-generated conclusions; and
- decisions based on third-party pricing or availability.
33. No Professional Advice
Unless BulkBrains expressly agrees otherwise in writing, the Services do not provide legal, financial, medical, engineering or other regulated professional advice.
Outputs should not replace advice from an appropriately qualified professional where such advice is required.
34. Consumer Rights
If you are a Consumer, Services supplied by BulkBrains remain subject to applicable statutory consumer protections.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
Where a digital service is required by law to conform to its contractual description, functionality or other statutory requirements, those requirements apply.
35. Disclaimer for Business Users
This section applies to Business Users to the fullest extent permitted by law.
Except where expressly stated in a separate written agreement, Services are provided on an “as available” basis.
BulkBrains does not warrant that a Service will:
- be uninterrupted;
- be error-free;
- satisfy every business requirement;
- preserve every item of data;
- provide completely accurate analytics;
- generate accurate AI results;
- remain compatible with every third-party service; or
- achieve any particular commercial result.
36. Excluded Business Losses
To the fullest extent permitted by law, BulkBrains will not be liable to a Business User for:
- loss of profit;
- loss of revenue;
- loss of business;
- loss of opportunity;
- loss of expected savings;
- loss of goodwill;
- loss of analytics;
- loss or corruption of data;
- business interruption;
- indirect loss;
- consequential loss;
- special loss; or
- losses resulting from third-party services.
This applies to the fullest extent permitted by law and does not exclude liability that cannot lawfully be excluded.
37. Business Liability Cap
To the fullest extent permitted by law, BulkBrains' total aggregate liability to a Business User arising out of or relating to a Service or these Terms will not exceed the total fees actually paid by that Business User to BulkBrains for the affected Service during the 12 months immediately preceding the event giving rise to the claim.
Where the affected Service was supplied entirely free of charge and the Business User paid no fees during that period, BulkBrains' total aggregate liability will not exceed €25.
This cap applies across all claims arising from the same or substantially related events.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
38. Consumer Liability
Nothing in these Terms limits BulkBrains' liability to a Consumer where such limitation is prohibited by applicable law.
Subject to those mandatory protections, BulkBrains is not responsible for losses that:
- were not reasonably foreseeable when the contract was formed;
- result from misuse of a Service;
- result from information supplied incorrectly by the user;
- arise because the user failed to maintain reasonable backups;
- arise from third-party systems outside BulkBrains' reasonable control; or
- relate to business or commercial activity carried out by a person acting as a Consumer.
39. Events Outside Our Control
BulkBrains will not be responsible for delay or failure caused by circumstances outside its reasonable control, subject to any rights that cannot legally be excluded.
Such circumstances may include:
- internet failures;
- hosting outages;
- third-party API failures;
- cyberattacks;
- power failures;
- natural disasters;
- governmental action;
- platform shutdowns;
- strikes; or
- widespread network disruption.
40. Responsibility of Business Users
Business Users are responsible for ensuring that:
- they have lawful authority to submit data to BulkBrains;
- they have permission to access systems they connect;
- API credentials and integration keys are lawfully obtained;
- their collection of analytics or player data is lawful;
- appropriate privacy notices are provided;
- any required consents are obtained;
- their use of third-party platforms complies with those platforms' terms; and
- User Content does not infringe third-party rights.
41. Business User Indemnity
To the fullest extent permitted by law, a Business User will indemnify BulkBrains against reasonable losses, liabilities, claims, damages and costs arising directly from that Business User's:
- unlawful User Content;
- infringement of third-party intellectual-property rights;
- unlawful collection or processing of personal data;
- unauthorised access to third-party systems;
- misuse of Roblox data;
- misuse of APIs or credentials; or
- material breach of these Terms.
This does not apply to the extent that the relevant loss was caused by BulkBrains' own wrongful conduct.
This section does not apply to Consumers except to the extent permitted by mandatory law.
42. Separate Agreements
BulkBrains may enter into separate agreements including enterprise agreements, custom pricing agreements, Data Processing Agreements, Service Level Agreements and other negotiated contracts.
Where a signed or expressly accepted separate agreement conflicts with these Terms, that agreement will prevail to the extent of the conflict.
43. Privacy
Personal information is processed in accordance with the applicable BulkBrains Privacy Policy.
The Privacy Policy is separate from these Terms and explains how personal information is collected, used, retained and shared.
44. Communications
By maintaining a BulkBrains account, you agree that BulkBrains may send essential service communications concerning:
- account security;
- billing;
- Service changes; and
- changes to these Terms.
These operational communications are separate from marketing communications.
45. Changes to These Terms
BulkBrains may update these Terms from time to time.
Minor administrative, technical or clarifying changes may take effect when published.
Where a change materially affects users' rights or obligations, BulkBrains will normally provide at least 7 days' notice by email before the change takes effect, unless a shorter period is reasonably required because of law, security, fraud prevention, emergency technical issues or requirements imposed by a third party.
Where required, users may be asked to actively accept materially revised Terms.
Where legally permissible, continuing to use the Services after revised Terms take effect constitutes acceptance of the updated Terms.
46. Governing Law
These Terms are governed by the laws of Ireland.
If you are a Consumer, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.
47. Courts and Disputes
Before commencing formal proceedings, we encourage you to contact BulkBrains at support@bulkbrains.com so that we can attempt to resolve the issue.
For disputes involving Business Users, the courts of Ireland will have jurisdiction unless a separate written agreement states otherwise.
Consumers retain any right they have under applicable law to bring proceedings in another competent court.
Nothing in these Terms requires a Consumer to give up a statutory right to take legal action.
48. No Waiver
If BulkBrains does not immediately enforce a provision of these Terms, that does not mean the provision has been waived.
49. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
Where possible, the affected provision will be interpreted as narrowly as necessary to make it lawful and enforceable.
50. Assignment
You may not assign your rights or obligations under these Terms without BulkBrains' prior written permission.
BulkBrains may transfer its rights and obligations as part of a legitimate transfer, restructuring or sale of the BulkBrains business or relevant Service, provided that Consumer rights are not reduced contrary to applicable law.
51. Entire Agreement
These Terms, together with any applicable product-specific terms, disclaimers, purchasing terms, enterprise agreement, DPA or other agreement expressly incorporated into them, form the agreement governing your use of the relevant Service.
